These Terms of Service ("Terms") govern your use of RidePal LLC's mobile application, website, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
Before using map functionality in the app, users are asked to agree to map usage terms regarding trail safety and liability. By using map features, you agree that:
To support ride recording, route visualization, and related features, the app may use GPS, background location, motion/fitness, and other device permissions you choose to grant. You understand and agree:
Mountain biking and off-road cycling are inherently dangerous activities and may result in injury, property damage, or death. You voluntarily assume all risks associated with use of the Services and your related activities.
You may submit content to the Services, such as ride data, routes, trail submissions and edits, photos, reviews, ratings, and comments ("User Content"). You retain ownership of your User Content.
By submitting User Content, you grant RidePal a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, modify and reformat (for example, resizing photos or generating previews), publicly display, distribute, and create derivative works from your User Content — in the app, on the RidePal website, and in RidePal's promotion of the Services — with attribution to your display name where shown. This license permits other users to view your public User Content through the Services. The license continues for as long as your User Content remains on the Services; contributions to the shared trail map (such as trail locations, geometry, names, and corrections) remain part of the RidePal trail database even after account deletion.
You are responsible for your User Content. You represent that you own it or have the rights needed to grant this license, and that it does not infringe anyone's rights, violate any law, or misrepresent trail access (for example, mapping trails on private property as open). Do not upload content that is unlawful, infringing, hateful, or unrelated to trails and riding.
We may review, moderate, decline, or remove User Content at any time, including through automated moderation systems, and we are not obligated to host or display any User Content. To report content that infringes your rights, contact contact@ridepal.app.
RidePal may invite a business to claim a shop or rental listing using contact information associated with that business. Accepting an invitation does not transfer ownership of the underlying map record. It authorizes the connected RidePal account to propose public listing details and media for review.
Approved business content is User Content under these Terms and may be publicly displayed in RidePal apps, websites, maps, previews, and related promotional materials. Contact contact@ridepal.app to dispute a claim or request a change to business access.
The Services may rely on third-party platforms and data providers (including mapping, hosting, authentication, analytics, subscriptions, and connected fitness services). We are not responsible for third-party services, terms, availability, content, or privacy practices.
Some features require paid subscriptions or purchases processed by third-party app stores or billing providers. Pricing, taxes, billing terms, renewal terms, and refund eligibility are determined by those providers and applicable law. We may change paid features or pricing at any time to the extent allowed by law.
If you download or use RidePal through Apple's App Store or another marketplace, your use may also be subject to that platform's standard terms, license terms, and policies.
We may suspend or terminate access to the Services at any time for violations of these Terms or to protect our users, systems, or business.
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless RidePal and its affiliates, officers, employees, and partners from claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your content, or your violation of these Terms or applicable law.
THE SERVICES, MAPS, TRAILS, RIDE METRICS, ALERTS, AND ALL RELATED CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ACCURATE, COMPLETE, RELIABLE, UNINTERRUPTED, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIDEPAL SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. TO THE FULLEST EXTENT PERMITTED BY LAW, RIDEPAL DISCLAIMS LIABILITY FOR ACCIDENTS, INJURIES, PROPERTY DAMAGE, LOSSES, OR OTHER DAMAGES INCURRED WHILE USING THE SERVICES OR RELYING ON MAP OR TRAIL DATA. YOU AGREE TO HOLD RIDEPAL HARMLESS FROM CLAIMS ARISING FROM YOUR USE OF MAP OR TRAIL DATA.
These Terms are governed by applicable law in the jurisdiction where RidePal LLC is organized, without regard to conflict of law principles, except where otherwise required by law.
We may modify these Terms from time to time. Updates will be posted on this page with the "Last updated" date. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
