Terms of Service

These Terms of Service ("Terms") govern your use of RidePal LLC's mobile application, website, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Eligibility and Accounts

• You must be at least 13 years old to use the Services.
• You are responsible for your account credentials and for all activity under your account.
• You must provide accurate information and keep it up to date.
• You may not misuse the Services, interfere with operation, or violate applicable law.

Map and Trail Data Terms

Before using map functionality in the app, users are asked to agree to map usage terms regarding trail safety and liability. By using map features, you agree that:

• Map and trail data (including trail locations, ratings, and descriptions) may come from third-party contributors, including OpenStreetMap, and from user submissions.
• This information may be inaccurate, incomplete, or outdated, and may not reflect current conditions.
• RidePal does not independently verify trail existence, safety, condition, ownership status, access rights, closures, reroutes, hazards, or legal status.
• Display of a trail is not a recommendation or representation that it is safe, open, legal, or suitable.

Ride Tracking and Location Features

To support ride recording, route visualization, and related features, the app may use GPS, background location, motion/fitness, and other device permissions you choose to grant. You understand and agree:

• Accurate ride tracking may require continuous or background location permissions (such as "Always" location access).
• Ride, map, and tracking outputs may be delayed, inaccurate, or incomplete due to signal loss, terrain, device state, operating system behavior, third-party service issues, or other factors.
• You are solely responsible for your route choices, trail decisions, speed, and on-trail conduct.
• The Services are not emergency, rescue, dispatch, or safety-monitoring systems.

Assumption of Risk

Mountain biking and off-road cycling are inherently dangerous activities and may result in injury, property damage, or death. You voluntarily assume all risks associated with use of the Services and your related activities.

User Content

You may submit content such as ride data, routes, photos, and comments. You retain ownership of your content, but grant RidePal a non-exclusive, worldwide, royalty-free license to host, use, reproduce, modify, and display that content as needed to operate, maintain, and improve the Services.

Third-Party Services

The Services may rely on third-party platforms and data providers (including mapping, hosting, authentication, analytics, subscriptions, and connected fitness services). We are not responsible for third-party services, terms, availability, content, or privacy practices.

Paid Features and Subscriptions

Some features require paid subscriptions or purchases processed by third-party app stores or billing providers. Pricing, taxes, billing terms, renewal terms, and refund eligibility are determined by those providers and applicable law. We may change paid features or pricing at any time to the extent allowed by law.

App Store Terms

If you download or use RidePal through Apple's App Store or another marketplace, your use may also be subject to that platform's standard terms, license terms, and policies.

Termination

We may suspend or terminate access to the Services at any time for violations of these Terms or to protect our users, systems, or business.

Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless RidePal and its affiliates, officers, employees, and partners from claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your content, or your violation of these Terms or applicable law.

Disclaimers

THE SERVICES, MAPS, TRAILS, RIDE METRICS, ALERTS, AND ALL RELATED CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ACCURATE, COMPLETE, RELIABLE, UNINTERRUPTED, OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIDEPAL SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. YOU AGREE TO HOLD RIDEPAL HARMLESS FROM CLAIMS ARISING FROM YOUR USE OF MAP OR TRAIL DATA.

Governing Law

These Terms are governed by applicable law in the jurisdiction where RidePal LLC is organized, without regard to conflict of law principles, except where otherwise required by law.

Changes to These Terms

We may modify these Terms from time to time. Updates will be posted on this page with the "Last updated" date. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
